§ 1 General
The Operator of the “Otto Kern Signature SPEED” contest (hereinafter referred as the “contest”) is MÄURER & WIRTZ GmbH & Co. KG (hereinafter referred to as the “Operator”).
The recipient of the information provided relating to the participant in the contest is MÄURER & WIRTZ GmbH & Co. KG. The website of MÄURER & WIRTZ GmbH & Co. KG is available at www.m-w.de as well as www.ottokern-fragrances.de. All questions, comments or complaints on the contents must be addressed solely to MÄURER & WIRTZ GmbH & Co. KG.
It is basically free to take part in the contest. However, costs may be incurred with third parties for the transfer of participant data, e.g. costs for the data connection.
§ 2 Contest process
The contest begins on January 5, 2015. Every participant can take part in the contest up to the end of February 29, 2026 by entering his personal data on the Otto Kern website (www.ottokern-fragrances.de). The following data is required in order to participate: The surname, first name and email address of the participant.
The winner among all participants is decided by lot. Each winner will be informed of his win by the end of March 15, 2016, by email. If the winner does not get in touch by March 31, 2016, at the latest, the claim to prize shall expire.
Following a response from the winner by email, stating an address for dispatch, the prizes will be sent to the winners with a letter providing notification of the win.
§ 3 Prizes

The Operator shall be entitled to exchange the announced prizes at any time, and to replace them with other winnings and prizes that are of the same value. In such instances, the winners are not entitled to any claims against the Operator or against legally affiliated companies. It is not possible for the cash equivalent of the prizes to be paid out.
§ 4 Entitlement to participate
The minimum age for participation in the contest is 21 years. Each participant must be resident in Germany and own a valid Class 3 or B driver’s license. This driver’s license must have been held by the participant for at least 3 years. The participant must also be in a normal mental and physical condition, and must not have any physical or mental disability. Employees of the Operator and of MÄURER & WIRTZ GmbH & Co. KG, or employees of companies affiliated with the Operator as well as their family members are excluded from participation. This regulation also applies to freelance and salaried employees of companies and agencies that are included in the planning, organisation and processing of the contest.
Some of the specified participation entitlement requirements are established by the conditions applied by the company MyDays, as the organiser and holder of the racing car trip. The full terms and conditions of MyDays are detailed at the end of these participation conditions.
There is no claim to participation in the contest. The Operator may refuse datasets without stating reasons, and retains the right to exclude participants from the contest should they breach these terms of participation. Participants who try to disrupt or manipulate the process of the contest, or to achieve an advantage by using unauthorised tools, may also be excluded from participation. Multiple participation is not permitted.
In cases of doubt, the Operator is entitled, stating an email address, to demand that each winner provides verification of his identity e.g. by providing a copy of a suitable identity document. For the event that proofs of this type are not provided promptly, this may result in exclusion from the contest or to the loss of entitlement to win.
To participate in the drawing of lots, the participant must provide his personal contact details (surname, first name, email address) in full, truthfully and acknowledging the terms of participation. Otherwise, he may be excluded from the contest.

§ 5 General indemnification
By participating in the contest, the participator exempts the organiser, associated partners/sponsors and all their respective parents companies, subsidiaries, affiliates, managing directors, salaried employees, colleagues and representatives from any liability and all third-party claims, and commits to forego any claims that may arise due to costs, breaches, losses or damage of any type that arise from or in connection with the contest or delivery, failed delivery, acceptance, ownership, use or inability to use a prize, or from laws of publication or data protection laws, slander or representation in an incorrect light (whether with intent or unintentionally), whether in the framework of a contract, damage event or guarantee or otherwise.
The organiser in particular accepts no liability for errors, ommissions, interruptions, deletions, shortcomings, delays in conducting the contest or transfer, failures in communication lines and theft or destruction or unauthorised access or change to contents and/or notifications to the participants.
Regarding conducting the contest, the organiser is only liable for damage that is based on a grossly negligent breach of obligation on the part of the organiser, or on a deliberate or grossly negligent breach of obligation on the part of one of its legal representatives or vicarious agents. The Operator is also liable in the event of breaches of a fundamental contractual duty (“cardinal duty”). In the event of negligence, this liability is however limited to the typical damage that is foreseeable at the time that the contract is concluded. In all other cases, liability on the part of the Operator is expressly ruled out.
§ 7 Contest termination
The Operator reserves the right to terminate or end the contest without advance notice and without stating reasons. The Operator shall take this option in particular if proper performance cannot be guaranteed for legal reasons.
§ 8 Privacy policy
All data entered and/or uploaded is subject to statutory data protection provisions.
Participation in the contest requires that personal data be provided. The participant’s surname, first name and email address will only be used to ascertain the winner and to provide notification of the win. The winners’ addresses provided in response to being informed of a win will only be used to transfer the prize with a prize notification. Use going beyond this will not occur. All personal data will be handled by the organiser in accordance with the statutory provisions (in particular the applicable data protection laws). The organiser is entitled to process to the required scope the personal data, obtained within the contest, for the purpose named above pursuant to the provisions of the Federal Data Protection Act. After performing and processing the contest, all data will be deleted again unless the participant has explicitly requested or approved further contact or similar. The participant is entitled to receiving information or notification in accordance with the statutory specifications and may withdraw his participation in the contest and/or the processing of his data at any time by sending a notification to the organiser, with immediate effect. This results in exclusion from the contest.
§ 9 Closing provisions
Should individual provisions in these terms of participation be or become ineffective, inadmissible or infeasible, this shall not affect the efficacy of the other terms of participation. The terms of participation may be changed at any time without separate notification. The law of the Federal Republic of Germany applies. There is no right of appeal.
